К сожалению сложившаяся в нашей стране многолетняя кабальная практика договорных отношений с собственниками коммерческой недвижимости имеет место быть в настоящее непростое для всей страны время.
Владельцы коммерции, как правило, перекладывают все проблемы помещений, здания на своих арендаторов.
Убытки несут арендаторы. Если что-то не устраивает, арендатор попросту может остаться на улице.
Однако не все так плохо, если своевременно обратиться за квалифицированной юридической помощью.
В настоящий момент в Симоновском суде г. Москвы рассматривается иск Правительства Москвы о сносе ТЦ «Конфетти».
Учитывая судебную практику по аналогичным спорам, текущую стадию незавершенности строительством здания ТЦ «Конфетти», аварийное состояние несущих конструкций, инженерных систем и санитарного состояния здания, спасти торговый центр может разве что отказ Правительства Москвы от иска, чего, конечно же, представить невозможно.
Не сложно догадаться, что убытки понесенные арендаторами коммерческой недвижимости ТЦ «Конфетти» никто по совести и доброй воле разделить не захочет.
В этой связи хочу обратить Ваше внимание на вступивший в силу судебный акт Арбитражного суда г. Москвы, дело №А40-106900/2022, которым установлена аварийность несущих конструкций и инженерных систем здания ТЦ «Конфетти» и обязанность собственника помещения возместить ВСЕ понесенные арендатором убытки в полном объеме, в том числе упущенную выгоду!
